1. Agreement to Terms

By accessing or using the services of DFW Christmas Lights LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our services or website.

2. Services

DFW Christmas Lights LLC provides professional Christmas light installation, removal, storage, maintenance, and custom design services for residential and commercial properties in the Dallas-Fort Worth area.

2.1 Service Scope

Our services include, but are not limited to:

  • Design consultation
  • Christmas light installation
  • Commercial holiday lighting
  • Custom lighting design
  • Takedown and removal services
  • Repair and maintenance
  • Storage services

2.2 Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of services.

3. Quotes and Pricing

3.1 Quote Validity

All quotes are valid for 30 days from the date of issue unless otherwise specified. Quotes are estimates and may be subject to change based on site conditions, scope changes, or material availability.

3.2 Payment Terms

Payment terms will be specified in your service agreement. Typical payment structure includes:

  • Deposit required at time of booking
  • Balance due upon completion of installation
  • Late payments may incur additional fees

3.3 Cancellation Policy

Cancellations made more than 7 days before scheduled installation will receive a full refund minus a $50 administrative fee. Cancellations made within 7 days of installation may forfeit the deposit. Emergency cancellations will be evaluated on a case-by-case basis.

4. SMS/Text Messaging Terms (A2P Compliance)

4.1 Consent to Text Messages

By providing your mobile phone number and expressly consenting to receive text messages (by checking a box, submitting a form with text as preferred contact, or replying affirmatively to an opt-in message), you agree to receive text messages from DFW Christmas Lights LLC. This includes:

  • Appointment reminders and confirmations
  • Service updates and notifications
  • Quote follow-ups
  • Weather-related service alerts
  • Marketing messages (only if you separately opt in)

4.2 Message Frequency

Message frequency varies. You may receive up to 10 messages per month depending on your service schedule and interaction with our company. We will not send excessive messages.

4.3 Message and Data Rates

Standard message and data rates may apply based on your mobile carrier's plan. We are not responsible for any charges incurred by your carrier. Contact your carrier for details about your messaging plan.

4.4 Supported Carriers

Our text messaging service is supported by all major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and most regional carriers. Availability may vary.

4.5 Opt-Out Rights

You may opt out of receiving text messages at any time by:

  • Texting "STOP" to any message from us
  • Texting "UNSUBSCRIBE" to any message from us
  • Calling us at (817) 555-0100

After opting out, you will receive one confirmation message. No further messages will be sent unless you opt back in. Please note that opting out of text messages may affect our ability to provide timely service updates.

4.6 Help Command

For help, text "HELP" to any message or call (817) 555-0100. You will receive information about how to use our text messaging service and how to opt out.

4.7 Privacy and Data Usage

Your mobile number and any information you provide via text message will be used in accordance with our Privacy Policy. We do not share your mobile number with third parties for their marketing purposes. We use a third-party SMS service provider to deliver messages.

4.8 Delivery and Reliability

While we strive to deliver all messages reliably, we cannot guarantee delivery due to factors outside our control including carrier issues, network problems, or device compatibility. We are not liable for any delays or failures in message delivery.

4.9 Number Changes

If you change your mobile number, please notify us immediately at (817) 555-0100 or info@dfwchristmaslights.com to update our records and prevent messages from being sent to an incorrect recipient.

5. Property Access and Conditions

5.1 Site Access

You agree to provide safe, unobstructed access to all areas where services are to be performed. This includes ensuring pets are secured and that walkways, driveways, and work areas are clear.

5.2 Property Condition

You represent that your property's roof, gutters, electrical systems, and mounting surfaces are in good condition and suitable for light installation. We are not responsible for damage to pre-existing defects or deteriorated surfaces.

5.3 Electrical Requirements

You agree to provide access to appropriate electrical outlets. Your electrical system must meet current code requirements. We may refuse installation if electrical systems are deemed unsafe.

6. Liability and Insurance

6.1 Insurance Coverage

DFW Christmas Lights LLC maintains general liability insurance and workers' compensation coverage. Certificates of insurance are available upon request.

6.2 Limitation of Liability

Our liability is limited to the amount paid for services. We are not liable for indirect, incidental, special, or consequential damages. We are not responsible for:

  • Acts of nature (storms, high winds, etc.)
  • Damage caused by third parties or animals
  • Pre-existing property defects
  • Electrical issues caused by property's electrical system
  • Delays due to weather conditions

6.3 Warranty

We warranty our workmanship and materials for the current season. If lights malfunction due to our installation, we will repair or replace at no charge. This warranty does not cover damage from weather, accidents, or misuse.

7. Weather and Scheduling

Installation schedules are weather-dependent. We reserve the right to reschedule installations due to unsafe weather conditions. We will make every effort to notify you of schedule changes as soon as possible.

8. Storage Terms

If you choose our storage service, your lights will be stored in our climate-controlled facility. We take reasonable care of stored items but are not liable for damage from events beyond our control. Storage is included with full-service annual contracts.

9. Intellectual Property

All custom designs, plans, and layouts created by DFW Christmas Lights LLC remain our intellectual property. You may not reproduce or share these designs without written permission.

10. Marketing and Photography

We may photograph completed installations for marketing purposes. By using our services, you consent to the use of photos of your property in our marketing materials unless you notify us in writing that you opt out.

11. Dispute Resolution

11.1 Informal Resolution

If you have a dispute with us, please contact us first to attempt informal resolution at (817) 555-0100 or info@dfwchristmaslights.com.

11.2 Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law provisions. Any disputes will be resolved in the courts of Texas.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms otherwise remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any service agreements, constitute the entire agreement between you and DFW Christmas Lights LLC regarding our services.
